Terms of Use
Effective October 6, 2026
These Terms of Use ("Terms") govern your access to and use of PickleCheck, including the PickleCheck mobile application, website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and acknowledge the PickleCheck Privacy Policy.
Who may use PickleCheck
You must be able to form a binding agreement under applicable law to create an account. PickleCheck is not directed to children under 13. If you use PickleCheck on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Your account
You are responsible for providing accurate account information, maintaining the security of your sign-in credentials, and activity that occurs through your account. Do not share another person's account, impersonate another person, or attempt to access an account you do not own. Notify us at support@picklecheck.com if you believe your account has been compromised.
Court activity and location information
PickleCheck helps players understand activity at pickleball courts through check-ins, plans to play, crowd reports, court information, and other community signals. These signals may be delayed, incomplete, inaccurate, or change quickly. PickleCheck does not guarantee that a court is open, available, safe, uncrowded, or suitable for play.
When you use proximity-based features, you agree not to falsify your location, submit fraudulent check-ins, or intentionally misrepresent court activity. Always follow posted facility rules, local laws, and instructions from court or facility operators.
Plans, drills, and meetups
Plans to play, drill sessions, and similar features are tools for coordinating with other users. PickleCheck is not responsible for another user's attendance, skill level, conduct, or representations. Use reasonable judgment when meeting other people and choose public, appropriate locations for play.
Community content and communications
The Service may allow you to post or submit court information, Court Board posts and comments, photos, messages, drill-session conversations, reports, profile information, and other content ("User Content"). You retain ownership of your User Content, but you grant PickleCheck a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, process, and transmit that content as reasonably necessary to operate, secure, moderate, and improve the Service.
You are responsible for the User Content you submit. Do not submit content that infringes another person's rights or that contains unlawful, threatening, harassing, hateful, sexually inappropriate, fraudulent, deceptive, abusive, or malicious material.
Messaging and safety
Direct messages and drill conversations are provided to support pickleball-related communication. Do not use messaging for harassment, threats, scams, spam, impersonation, unwanted sexual content, or unlawful activity. Use the available report and block tools when appropriate. PickleCheck may review reported content and related context when reasonably necessary to investigate abuse, protect users, enforce these Terms, or maintain the security of the Service.
PickleCheck is not an emergency service. If you or another person is in immediate danger, contact local emergency services.
Prohibited conduct
You may not:
- Use the Service for unlawful, fraudulent, abusive, or harmful activity.
- Harass, threaten, stalk, exploit, or impersonate another person.
- Submit false check-ins, crowd reports, court information, or other intentionally misleading activity data.
- Attempt to bypass proximity checks, access controls, rate limits, security measures, or account restrictions.
- Scrape, reverse engineer, disrupt, overload, or interfere with the Service except where such restriction is prohibited by applicable law.
- Upload malicious code or attempt unauthorized access to PickleCheck systems or data.
- Use the Service to send spam, scams, or unsolicited commercial messages.
Moderation and enforcement
PickleCheck may investigate reports, remove or limit content, restrict features, suspend accounts, or terminate access when we reasonably believe it is necessary to enforce these Terms, protect users, prevent abuse or fraud, comply with law, or protect the Service. We may preserve information associated with a safety or abuse report when reasonably necessary for investigation, enforcement, or legal obligations.
Photos, names, and other rights
Only upload photos and other content that you have the right to use. Do not post another person's private information without authorization. If you believe content on PickleCheck infringes your rights, contact support@picklecheck.com with enough information for us to review the request.
Third-party services
PickleCheck may rely on or link to third-party services such as Apple, Google, Microsoft, Expo, mapping providers, authentication providers, app stores, and hosting services. Those services are governed by their own terms and policies, and PickleCheck is not responsible for third-party services outside our control.
Service changes and availability
We may add, change, suspend, or discontinue features as PickleCheck evolves. We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation.
Disclaimers
To the extent permitted by law, PickleCheck is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. PickleCheck does not warrant the accuracy of user-submitted information, court availability, player attendance, facility conditions, or information supplied by third parties.
Limitation of liability
To the extent permitted by applicable law, PickleCheck and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Service, interactions with other users, reliance on community information, or inability to use the Service. Nothing in these Terms excludes liability that cannot legally be excluded.
Account deletion and termination
You may delete your account using the account-deletion feature in PickleCheck. We may suspend or terminate access when permitted by these Terms. Provisions that by their nature should survive termination, including intellectual-property, disclaimer, limitation-of-liability, and enforcement provisions, will continue to apply.
Privacy
Our Privacy Policy explains how PickleCheck collects, uses, retains, and protects information associated with the Service.
Changes to these Terms
We may update these Terms as PickleCheck changes. We will post the revised Terms here and update the effective date. When required, we may provide additional notice through the app or another appropriate method. Your continued use of the Service after revised Terms take effect constitutes acceptance of the updated Terms to the extent permitted by law.
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
